1. Legislative Background and Necessity

1.1

Capital's Special Security Needs

As a megacity with a large population and complex environment, Beijing faces significant challenges in managing unmanned aircraft. The capital has busy air routes, dense clusters of historical and cultural heritage sites, a high concentration of public service facilities (water, electricity, gas, heat, oil), and extensive radio applications. Unmanned aircraft that lose control can easily cause injury or property damage, interfere with normal radio communications, and the consequences of collision with civil aviation aircraft or military aircraft are unthinkable. Strengthening unmanned aircraft management through local legislation has become extremely urgent. (Source: Explanation on the Beijing Unmanned Aircraft Management Regulation (Draft))

1.2

Practical Foundation

This regulation is based on three key practical foundations:

3.3

Definition of Core Components

Article 5, paragraph 3 of this regulation authorizes the Municipal Economic and Information Technology Department, in conjunction with relevant departments, to formulate the core components catalog for unmanned aircraft. This catalog serves as the basis for determining the scope of objects subject to the sales prohibition, transport prohibition, and storage restrictions. The specific catalog shall be based on the official version published by the municipal economic and information technology department.

4. Article-by-Article Interpretation

Article 1 -- Legislative Purpose and Basis

Original text: This regulation is formulated in accordance with the Civil Aviation Law of the People's Republic of China, the Counter-Terrorism Law of the People's Republic of China, the Interim Regulation on the Flight Management of Unmanned Aircraft, and other laws and administrative regulations, taking into account the actual conditions of Beijing, for the purpose of strengthening the management of unmanned aircraft in this city and maintaining the safety of the capital.

Interpretation: This article clearly states that the legislative purpose is to "maintain the safety of the capital," reflecting Beijing's special position as the capital. The superior legal basis includes three laws/administrative regulations, of which the Interim Regulation on the Flight Management of Unmanned Aircraft is the most direct superior law. The phrase "taking into account the actual conditions of Beijing" provides legal space for the city to adopt stricter management measures than national regulations.

Article 2 -- Management Responsibility System

Original text: The municipal and district governments shall strengthen the management of unmanned aircraft within their respective administrative areas and urge relevant departments to perform their duties in accordance with the law. The municipal public security authorities shall be responsible for guiding and supervising the safety management of unmanned aircraft in this city, working with relevant departments to implement national and local safety prevention and control management regulations, and providing policy publicity and guidance services. The municipal market supervision, transportation, emergency management, education, science and technology, economic and information technology, agriculture and rural affairs, landscaping and greening, sports, as well as postal, railway, civil aviation, and communications departments shall strengthen unmanned aircraft management in accordance with their respective responsibilities.

Interpretation: This article establishes a three-tier management system of "government coordination + public security leadership + departmental collaboration":

LevelResponsibility
Municipal/district governmentsOverall leadership, supervising departmental performance
Municipal public security authoritiesLead safety management, collaborate on safety prevention and control, policy publicity and guidance
14 relevant departmentsCollaborative management per their respective responsibilities

It is noteworthy that the public security authorities are not only responsible for law enforcement and penalties but also bear the responsibility of "policy publicity and guidance services," reflecting the integration of management and service.

Article 3 -- Registration and Information Verification System

Original text: The owner of an unmanned aircraft shall perform real-name registration and activation in accordance with relevant national regulations. Owners of existing unmanned aircraft shall proactively cooperate with the public security authorities to complete information verification within three months from the effective date of this regulation. If the owner is an entity, it shall designate a manager for the unmanned aircraft. The specific measures for information verification shall be formulated by the municipal public security authorities in conjunction with relevant departments.

Interpretation: This article establishes a dual registration requirement:

RequirementContentLegal Basis
National-level real-name registration and activationOwner must complete real-name registration and activation via the UOM platform (https://uom.caac.gov.cn)Article 10 of the Interim Regulation; Civil Unmanned Aircraft Real-Name Registration and Activation Requirements (effective May 1, 2026)
Beijing local information verificationExisting drone owners must cooperate with public security authorities to complete information verification within three months from May 1, 2026 (i.e., by July 31, 2026)Article 3, paragraph 2 of this regulation

Key points:

  • The deadline for registration and information verification is three months from the effective date, i.e., May 1 to July 31, 2026
  • Entity owners must designate a dedicated manager, assigning management responsibility to an individual
  • Specific information verification measures will be formulated by the municipal public security authorities in conjunction with relevant departments (supporting document)

Article 4 -- City-Wide Restricted Airspace

Original text: The entire administrative area of this city is designated as restricted airspace for unmanned aircraft. All outdoor flight activities of unmanned aircraft require an application, and no flight activities may be carried out without approval. Flight activity management shall be implemented in accordance with relevant national regulations. Taking into account safety assurance and actual needs, the city may designate dedicated flight sites for flight activities that are needed.

Interpretation: This article is the most core provision of this regulation, establishing three key systems:

  1. City-wide restriction: The entire Beijing administrative area (16 districts) is designated as restricted airspace, with no approved flight airspace. This differs from the national Regulation's general rule of "airspace outside restricted areas is approved flight airspace" -- Beijing has achieved city-wide control.
  2. Full approval required: All outdoor flight activities require an application, regardless of UAV type (micro, light, small, medium, large) or flight purpose. This is currently the strictest UAV flight control regulation nationwide.
  3. Dedicated flight sites: The government may designate dedicated flight sites for needed flight activities, reserving an institutional outlet for legitimate needs such as scientific research, teaching, and sports.

Background: On August 3, 2025, the Beijing Municipal Government issued the Notice on the Scope of Restricted Airspace for Unmanned Aircraft (JF [2025] No. 20), legally announcing the entire Beijing administrative area as restricted airspace. Effective December 1, 2025, at 00:00, the Central Air Traffic Control Office, together with MIIT, MPS and other departments, jointly established a drone electronic fence across the entire Beijing administrative area, providing technical support for city-wide control. (Source: JF [2025] No. 20)

Article 5 -- Sales Prohibition

Original text: It is prohibited to sell or lease unmanned aircraft and their core components to entities or individuals within the administrative area of this city. E-commerce operators shall take effective measures to implement the provisions of the preceding paragraph. The catalog of core components of unmanned aircraft shall be formulated by the municipal economic and information technology department in conjunction with relevant departments.

Interpretation: This article establishes a comprehensive sales prohibition for drones and their core components within Beijing:

Prohibition ElementContent
Prohibited actsSales, leasing
Prohibited objectsUnmanned aircraft and their core components
Prohibited territoryTo entities and individuals within the Beijing administrative area
E-commerce obligationsE-commerce operators must take effective measures to comply (e.g., platform blocking, merchant review, product delisting)
Core component scopeCatalog to be formulated by the municipal economic and IT department in conjunction with relevant departments

This prohibition means that ordinary consumers and entities cannot legally purchase or lease new drones or their core components within the Beijing area. The only legal channel to obtain them is through the special safeguard channel under Article 9.

Article 6 -- Transport and Carrying Restrictions

Original text: It is prohibited to transport or carry unmanned aircraft and their core components into the administrative area of this city, except for existing unmanned aircraft that have completed real-name registration and information verification and are carried by the owner or manager.

Interpretation: This article imposes strict restrictions on drones entering Beijing:

SituationPermitted?
General transport/carrying into BeijingProhibited
Existing drone that has completed registration and information verification, carried by owner or managerPermitted (exception)

Note that three conditions for the exception must all be met simultaneously:

  1. Must be an "existing" drone (i.e., one that existed before the regulation took effect)
  2. Must have completed real-name registration and information verification
  3. Must be carried by the owner or a designated manager

This article is particularly important for out-of-town tourists -- bringing a drone into Beijing for tourism is a violation, even if it has been legally registered in the tourist's home city.

Article 7 -- Storage Management Regulations

Original text: The storage of unmanned aircraft and their core components in this city shall comply with the following provisions: (1) It is prohibited to establish storage sites within the area inside the Sixth Ring Road (including the Sixth Ring Road); (2) Storage sites in areas outside the Sixth Ring Road shall comply with safety specifications and pass a safety assessment by the public security authorities; (3) It is prohibited to construct new storage sites within the administrative area of this city.

Interpretation: This article establishes a three-tier storage control system:

AreaStorage RegulationConsequence
Inside Sixth Ring Road (incl. Sixth Ring Road)Storage sites prohibitedMust close, dispose within deadline
Outside Sixth Ring RoadMust comply with safety specs and pass public security assessmentMust rectify if assessment fails
City-wideProhibition on new storage sitesNo new storage sites allowed

This means existing storage sites inside the Sixth Ring Road must be closed and disposed of within a deadline; existing storage sites outside the Sixth Ring Road must pass a safety assessment to continue operation; and no new drone storage sites of any kind are permitted anywhere in the city.

Article 8 -- Prohibition on Illegal Modification

Original text: It is prohibited in this city to illegally produce, assemble, build, or modify unmanned aircraft; it is prohibited to illegally crack the operation control system of unmanned aircraft or change the出厂 performance or parameters of unmanned aircraft.

Interpretation: This article establishes two categories of prohibited acts: hardware-related (illegal production, assembly, building, or modification) and software-related (illegal cracking of operation control systems; changing出厂 performance or parameters). This targets common violations such as "cracking prohibition programs" and "flashing firmware to remove height restrictions." (Source: Six Questions on Drone Black Flight)

Article 9 -- Special Safeguard System

Original text: Where it is genuinely necessary to purchase, transport, or store unmanned aircraft and their core components under any of the following circumstances, special safeguards shall be granted after a security assessment: (1) Counter-terrorism, emergency rescue, major events; (2) Teaching, R&D, production needs of schools, research institutions, and enterprises; (3) Agricultural and forestry production; (4) Sports training and competitions.

Interpretation: This article serves as the statutory exemption channel from the sales prohibition, transport prohibition, and storage restrictions, providing an institutional outlet for legitimate needs. Special safeguards require approval through a security assessment by the municipal public security authorities in conjunction with relevant departments.

Article 10 -- Temporary Control During Major Events

Original text: During the holding of major national events, the public security authorities may, based on actual security prevention and control needs, take temporary management measures such as centralized sealing and storage of unmanned aircraft and their core components owned by entities and individuals. The owner or manager of the unmanned aircraft and its core components shall cooperate.

Interpretation: This article grants the public security authorities temporary control powers during major events. Historical practices include: In July 2025, 9 districts (Dongcheng, Xicheng, Chaoyang, Haidian, Fengtai, Shijingshan, Tongzhou, Changping, Mentougou) were designated as airspace restriction zones; in August 2025, 7 additional districts were added. These controls were implemented for the 80th anniversary commemoration of the Chinese People's War of Resistance Against Japanese Aggression and the World Anti-Fascist War. Article 11 -- Reporting and Reward System

Original text: Entities and individuals who discover violations of unmanned aircraft management regulations and report them to the public security authorities or other relevant departments, where the report is verified, shall be rewarded.

Article 12 -- Penalties (I): Registration, Sales, Transport, Flight, Modification Violations

Original text (summary): Violations of Article 3(2) (information verification), Article 5(1) (sales prohibition), Article 6 (transport prohibition) -- ordered to correct; if serious, the UAV and core components shall be confiscated, with a fine of 500-5,000 yuan for individuals and 1,000-10,000 yuan for entities. Violations of Article 4(1) (city-wide restricted flight) -- ordered to stop flight, fined up to 500 yuan; if serious, the UAV shall be confiscated with a fine of 1,000-10,000 yuan. Violations of Article 5(2) (e-commerce obligations) -- ordered to correct by market supervision authorities, fined 10,000-100,000 yuan; for e-commerce platforms, 20,000-100,000 yuan. Violations of Article 8 (illegal modification) and Article 10 (major event control) -- the UAV and core components shall be confiscated, with a fine of 500-5,000 yuan for individuals and 1,000-10,000 yuan for entities.

Interpretation: This article establishes differentiated penalties for four categories of violations. Notably, illegal modification and violation of major event controls carry the most severe penalties -- direct confiscation without a prior "order to correct" step.

Article 13 -- Penalties (II): Storage Violations

Original text (summary): Violations of Article 7(1)(1) (storage inside Sixth Ring Road) and Article 7(1)(3) (new storage sites) -- ordered to close the storage site and dispose within a deadline; fined 500-5,000 yuan for individuals, 5,000-50,000 yuan for entities; if not disposed by the deadline, the UAV and core components shall be confiscated. Violations of Article 7(1)(2) (storage outside Sixth Ring Road without passing assessment) -- ordered to correct; if correction is refused, the UAV and core components shall be confiscated, with a fine of 500-5,000 yuan for individuals and 5,000-50,000 yuan for entities.

Interpretation: Entity fines (5,000-50,000 yuan) are significantly higher than those for other violations (1,000-10,000 yuan), reflecting a stricter penalty approach for storage safety violations.

Article 14 -- Public Security Penalties and Criminal Liability

Original text (summary): Violations of this regulation that constitute public security offenses shall be punished in accordance with the Public Security Administration Punishments Law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.

Interpretation: This article connects this regulation with the Public Security Administration Punishments Law (2025 Revision, effective January 1, 2026). Article 46 of the Public Security Administration Punishments Law explicitly stipulates: "Flying civil unmanned aircraft in violation of airspace management regulations, where circumstances are relatively serious, shall result in detention of between 5 and 10 days and a fine of up to 500 yuan." In severe cases, it may also constitute crimes such as the crime of endangering public safety by dangerous means (Article 114 of the Criminal Law), the crime of negligently causing a serious accident (Article 233), and the crime of interfering with the operation of a radio communication system (Article 288).

Article 15 -- Management of Flying Toys

Original text: The municipal government shall, based on actual needs, formulate management measures for self-powered flying toys and airborne objects.

Interpretation: This article delegates the regulation of flying toys (such as certain types of toy aircraft, model helicopters) to the municipal government to formulate measures based on actual needs. At present, specific management measures for flying toys have not yet been issued.

Article 16 -- Effective Date

Original text: This regulation shall come into effect on May 1, 2026.

Interpretation: The regulation takes effect on May 1, 2026. Existing drone owners must complete registration and information verification within three months (i.e., by July 31, 2026).

10. FAQ: Frequently Asked Questions

Q1

What are the requirements for flying a drone in Beijing?

According to Article 4, the entire administrative area of Beijing is designated as restricted airspace for unmanned aircraft. All outdoor flight activities require an application and must not be carried out without approval. Before flying, you must: 1) Complete real-name registration and activation on the UOM platform; 2) Cooperate with public security authorities for information verification; 3) Submit a flight activity application through the UOM platform before each flight; 4) Obtain approval from the air traffic management authority. Indoor flights are not subject to this regulation.

Q2

Can out-of-town tourists bring drones when visiting Beijing?

No. According to Article 6, it is prohibited to transport or carry unmanned aircraft and their core components into the Beijing administrative area. The only exception is for existing unmanned aircraft that have completed real-name registration and information verification, carried by the owner or manager. A tourist's drone from outside Beijing does not qualify as existing (i.e., registered and verified in Beijing before the regulation took effect), so bringing it into Beijing is a violation.

Q3

Where can I buy a drone in Beijing?

According to Article 5, it is prohibited to sell or lease unmanned aircraft and their core components to entities or individuals within the Beijing administrative area. E-commerce operators must also take effective measures to comply. Therefore, it is not legally possible to purchase a new drone within Beijing (including online platforms shipping to Beijing addresses). If there is a genuine need, you must go through the special safeguard channel under Article 9, subject to a security assessment by the municipal public security authorities.

Q4

Can I be detained for flying a drone illegally?

Yes, potentially. According to Article 14, violations of this regulation that constitute public security offenses will be subject to public security penalties. Article 46 of the newly revised Public Security Administration Punishments Law, effective January 1, 2026, stipulates that flying civil unmanned aircraft in violation of airspace management regulations, where circumstances are relatively serious, shall result in detention of between 5 and 10 days. Illegally crossing national borders by drone shall result in detention of between 10 and 15 days. There have already been cases of Beijing residents being administratively detained for black flight.

Q5

How does the Beijing regulation differ from the national Interim Regulation?

The biggest difference lies in airspace management. The national regulation designates airspace below 120 meters AGL as approved flight airspace for micro, light, and small UAVs (no application required). In contrast, the Beijing regulation designates the entire region as restricted airspace with no approved flight airspace -- all outdoor flights require an application. Additionally, the Beijing regulation introduces new measures not covered by the national regulation, including sales prohibitions, transport restrictions, and storage management, establishing a full-chain control system.

Q6

How can existing drone owners retain compliance?

Existing drone owners must complete the following steps within three months from the effective date (May 1 to July 31, 2026): 1) Complete real-name registration and activation on the UOM platform; 2) Cooperate with public security authorities for information verification; 3) Entity owners must designate a manager. Once these steps are completed, the drone may be carried and used by the owner or the designated manager. However, even with compliant registration, each outdoor flight still requires individual application and approval.

Q7

How can research institutions and enterprises use drones in Beijing?

According to Article 9, schools, research institutions, and production enterprises that need to purchase, transport, or store unmanned aircraft and their core components for teaching, R&D, or production purposes may receive special safeguards following a security assessment by the municipal public security authorities in conjunction with relevant departments.

Q8

Are flying toys and kites also regulated?

According to Article 15, the management measures for self-powered flying toys and airborne objects will be formulated by the municipal government based on actual needs. Specific flying toy management measures have not yet been issued. However, during major events, Beijing has issued airspace restriction notices that include kites, balloons, and sky lanterns within the scope of prohibited airborne objects.

Q9

Are there rewards for reporting illegal drone flights?

Yes. According to Article 11, entities and individuals who report violations of unmanned aircraft management regulations to the public security authorities or other relevant departments, where the report is verified, will receive a reward. As of October 2025, Beijing police have rewarded 52 citizens who reported illegal black flight activities, and have strictly protected the confidentiality of the reporters' identity information.

Q10

What is the electronic fence and how does it affect flights?

The electronic fence is a virtual boundary established through software, hardware, and geographic information technology, designed to ensure drones fly safely within approved airspace. The Central Air Traffic Control Office, together with the Ministry of Industry and Information Technology, the Ministry of Public Security, and other departments, jointly established a drone electronic fence across the entire Beijing administrative area effective December 1, 2025. Drone manufacturers must pre-configure data, and users must update flight data in a timely manner.
